1. Introduction

Welcome to Boahu. By subscribing to or using our messaging and communication services, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully. If you do not agree to these Terms, you should not use our services.

2. Service Description

Boahu provides automated communication services designed specifically for senior care, including:

  • Appointment reminders via SMS text messages and voice calls
  • Service notifications and updates
  • Health-related communications and wellness check-ins
  • Medication reminders and health management support
  • Emergency detection and response coordination

3. Eligibility

You must be at least 18 years of age to subscribe to Boahu services. If you are subscribing on behalf of another person (such as an elderly parent or family member), you represent that you have the legal authority to do so and to accept these Terms on their behalf.

4. Consent to Receive Messages

4.1 Express Written Consent

By providing your mobile phone number and subscribing to Boahu services, you expressly consent to receive informational text messages (SMS) and voice calls from Boahu. This consent is not a condition of purchasing any goods or services. You understand that your consent applies to automated, pre-recorded, or artificial voice messages and text messages sent using an automatic telephone dialing system.

4.2 Opt-In Confirmation

After subscribing, you will receive a confirmation message to verify your enrollment. You must respond affirmatively to complete your subscription to Boahu services.

5. Message Frequency and Content

5.1 Message Frequency

Clients explicitly opt in to receive informational messages from Boahu. Message frequency varies based on:

  • Your scheduled appointments and services
  • Medication schedules and health management plans
  • Service updates and account notifications
  • Emergency situations requiring immediate attention

Typical frequency: You may receive up to 3 messages per week under normal circumstances. During periods of increased activity (such as upcoming appointments or health monitoring), frequency may temporarily increase. Emergency messages may be sent at any time as necessary.

5.2 Message Content

Messages will contain information related to your care and services, including appointment confirmations, reminders, service updates, health management tips, and other relevant communications. Messages will not contain marketing or promotional content unless you separately opt in to such communications.

6. Fees and Charges

6.1 Service Fees

Boahu's communication services may be included as part of your care package or may be subject to separate fees. Please refer to your service agreement for specific pricing information.

6.2 Carrier Charges

Standard message and data rates from your mobile carrier may apply. You are responsible for all charges from your mobile carrier. Please contact your carrier for details about your messaging plan and any applicable charges. Boahu is not responsible for any carrier charges you may incur.

7. Supported Carriers

Boahu services are available on the following U.S. mobile carriers:

  • AT&T
  • T-Mobile
  • Verizon Wireless
  • Sprint
  • Boost Mobile
  • Cricket Wireless
  • Metro PCS
  • U.S. Cellular
  • And other major carriers

Carrier coverage is not available in all areas. Check with your carrier for specific coverage details.

8. How to Opt Out

8.1 Text Message Opt-Out

You may stop receiving text messages at any time by replying STOP to any message from Boahu. You will receive a confirmation message confirming your opt-out. After opting out:

  • You will no longer receive text messages from Boahu
  • You may still receive voice calls if you have not opted out of those separately
  • You may re-enroll by contacting Boahu support

8.2 Voice Call Opt-Out

To opt out of voice calls, please contact Boahu support at info@boahu.com or reply STOP to any text message and specify that you wish to opt out of voice calls as well.

8.3 Managing Preferences

You may also manage your communication preferences by completing a web form, phone enrollment, or texting HELP and following the instructions provided. For assistance with managing your preferences, contact info@boahu.com.

10. Service Reliability and Limitations

10.1 No Guarantee of Delivery

Boahu is not responsible for delays in message delivery, failed delivery, or messages not received due to carrier issues, network problems, device compatibility, user error, or any other factors outside our control. Message frequency may vary, and actual delivery times may differ from scheduled times.

10.2 Not Emergency Services

IMPORTANT: Boahu messaging services are not a substitute for emergency services. In case of a medical emergency, always call 911 immediately. Do not rely solely on Boahu's communication services for emergency situations. While our system includes emergency detection capabilities, it should not be your primary method of requesting emergency assistance.

10.3 Device and Network Requirements

To receive messages, you must have a compatible mobile device with an active connection to a supported carrier network. You are responsible for maintaining your device, keeping it charged, and ensuring you have adequate mobile service coverage.

11. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy for detailed information about how we collect, use, and protect your personal information. Key points include:

  • We collect only the information needed to provide our services
  • We do not sell or share your personal information with outside parties except as required to deliver messages or comply with the law
  • Your health information is protected in accordance with HIPAA regulations where applicable
  • You have the right to access, correct, or request deletion of your personal information

12. Prohibited Uses

You agree not to:

  • Use the services for any unlawful purpose
  • Attempt to interfere with, disrupt, or gain unauthorized access to Boahu's systems
  • Share your account credentials with unauthorized persons
  • Use the services in any way that could harm Boahu or other users
  • Reproduce, modify, or create derivative works from our services without authorization

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOAHU AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM: (A) YOUR USE OR INABILITY TO USE THE SERVICES; (B) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN; (C) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICES; (D) ANY BUGS, VIRUSES, OR THE LIKE THAT MAY BE TRANSMITTED TO OR THROUGH OUR SERVICES BY ANY THIRD PARTY; (E) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE THROUGH THE SERVICES.

14. Indemnification

You agree to indemnify, defend, and hold harmless Boahu and its affiliates, officers, agents, employees, and partners from any claim, demand, loss, or damage, including reasonable attorneys' fees, arising out of or related to your use of the services, your violation of these Terms, or your violation of any rights of another person or entity.

15. Changes to These Terms

Boahu reserves the right to update or modify these Terms at any time without prior notice. Changes will be effective immediately upon posting to our website. Your continued use of our services after any changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically. Material changes may be communicated to you via message or email.

16. Termination

16.1 Termination by You

You may terminate your subscription to Boahu messaging services at any time by following the opt-out procedures described in Section 8 above or by contacting customer support.

16.2 Termination by Boahu

Boahu reserves the right to suspend or terminate your access to the services at any time, without notice, for conduct that we believe violates these Terms, is harmful to other users, or is otherwise inappropriate.

17. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Hawaii, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in court to prevent irreparable harm.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect, and the invalid or unenforceable provision shall be reformed to be valid and enforceable to the maximum extent permitted by law.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Boahu regarding the use of our messaging services and supersede any prior agreements or understandings.
